These Terms & Conditions ("Terms") govern your use of q-4u.com and any orders placed through TradeMaster LLC ("TradeMaster," "we," "us," or "our"). By placing an order or using the Platform, you agree to these Terms in full. If you do not agree, do not use the Platform.
1. Service Description
TradeMaster operates an aggregate material delivery platform serving the Metro Phoenix, Arizona area. We coordinate the delivery of bulk materials — including road base, decomposed granite, rock, sand, and similar aggregate products — from quarry and supply sources to customer-specified delivery addresses. TradeMaster acts as the delivery coordinator and is not the manufacturer or producer of materials.
2. Orders, Pricing, and Payment Authorization
- All pricing is calculated at the time of estimate and is valid for the session in which it is generated. Estimates are subject to change due to fuel surcharge fluctuations, pricing updates, or availability changes.
- When you submit an order, your payment card is authorized (a hold is placed) but not charged. Your card is charged on the morning of your scheduled delivery (typically around 6 AM Phoenix time).
- The authorized amount is the maximum you will be charged. Final charges will not exceed the authorized total shown at checkout.
- All prices are in U.S. dollars and include applicable material, delivery, and fee components as itemized at checkout.
3. Fees and Surcharges
- Delivery fee: Calculated based on distance from quarry source to delivery address, truck operating costs, and applicable margins. Shown at checkout.
- Fuel surcharge: A fuel surcharge is applied to deliveries based on current diesel fuel index rates (EIA PADD 5 index), updated weekly. The surcharge rate is shown in the pricing breakdown at checkout and in your order confirmation email.
- Saturday surcharge: A surcharge of $40 applies to deliveries scheduled on Saturdays. This surcharge is disclosed at checkout when a Saturday delivery date is selected.
- Small load fee: Orders below a minimum tonnage threshold may incur a small load fee, shown at checkout.
- Long haul fee: Deliveries that require a longer haul from the source quarry may incur a long haul fee, shown at checkout.
- Tax: Applicable transaction privilege tax (TPT) is calculated and shown at checkout based on the delivery address jurisdiction.
4. Material Quantity and Weight Variance
Aggregate materials are bulk commodities. Delivered quantities may vary by up to ±10% from the ordered amount due to natural variation in material density, quarry loading practices, and truck payload limits. TradeMaster does not guarantee exact tonnage. If the delivered quantity is materially less than ordered, contact dispatch within 24 hours of delivery for resolution.
5. Delivery Windows and Scheduling
- Delivery windows (Morning, Midday, Afternoon) are estimates. Actual delivery times may vary due to route conditions, truck availability, quarry operating hours, weather, or other operational factors.
- TradeMaster will make reasonable efforts to notify you of material scheduling changes via SMS or phone.
- Delivery is to a curbside or accessible drop location at the delivery address. We do not deliver inside gates, structures, or locations inaccessible to a standard dump truck.
- Customer is responsible for ensuring the delivery site is accessible, safe, and capable of supporting a loaded commercial vehicle. TradeMaster is not liable for damage to driveways, landscaping, utilities, or other property resulting from delivery.
- If access is unavailable at the time of delivery and the driver cannot complete the run, the failed-delivery terms in Section 6 apply.
6. Failed Delivery
- A "failed delivery" means a dispatch in which TradeMaster's equipment arrives at the delivery address ready to dump but is unable to complete the delivery due to circumstances on the customer's side, including (without limitation) locked or inaccessible site, no clear or safe dump location, unstable ground, lack of overhead clearance, no reachable site contact, or other site conditions that make safe delivery impossible.
- Failed-delivery fee. When a delivery fails as defined above, TradeMaster will assess a $250 failed-delivery fee per truck, in addition to amounts already charged for the original material and delivery. This fee covers material disposal or recovery costs, route disruption, and the aborted run.
- Original material and delivery are non-refundable when a delivery fails on the customer's side. Material costs paid to the quarry and delivery costs already incurred do not return to the customer.
- Re-delivery. A subsequent delivery attempt requires a new order at then-current rates, including new material and a new delivery charge. Where TradeMaster is able to recover the original load (e.g., another contractor takes the material, or the load can be redirected to a future run), TradeMaster will work with the customer to reduce the new material and/or delivery charge accordingly. Reductions are at TradeMaster's sole discretion based on what is actually recovered.
- Quick recall. If the customer notifies TradeMaster before the truck has departed the area and the load can be redirected to the original site, the failed-delivery fee may be reduced or waived and no new material or delivery charge applies. Customer should contact dispatch immediately.
- When the fee does not apply. The failed-delivery fee does not apply when extreme weather causes cancellation, our equipment fails, our scheduling error, or any other cause attributable to TradeMaster rather than the customer's site.

7. Cancellations and Refunds
- You may cancel an order at no charge any time before the morning of your scheduled delivery (before the card is captured).
- On delivery day, once payment has been captured and the truck is loaded, cancellation is not available and the full authorized amount will have been captured.
- If TradeMaster is unable to fulfill a confirmed order due to operational failure, a full refund of any captured amount will be issued within 5–7 business days.
- Refunds for partial delivery shortfalls are handled on a case-by-case basis. Contact [email protected] within 24 hours of delivery.
- Card authorization holds that do not result in a captured charge will be released automatically per your card issuer's standard hold period (typically 5–7 business days).
8. SMS Messaging Program
Program name: TradeMaster Order & Delivery Notifications
Description: Transactional SMS notifications for order confirmation, payment authorization, dispatch confirmation, and delivery scheduling. Messages are sent only in connection with an active order. No marketing messages are sent.
Message frequency: Typically 2–4 messages per order.
Message and data rates may apply. Check with your wireless carrier.

9. Force Majeure
TradeMaster is not liable for failure or delay in performing its obligations resulting from causes beyond its reasonable control, including but not limited to: extreme weather, road closures, quarry shutdowns, material shortages, equipment failure, strikes, acts of god, or government action. In such cases, TradeMaster will notify you and either reschedule or cancel the order with a full refund.
10. Contractor Accounts
Contractor portal accounts are subject to separate pricing agreements. Contractors are responsible for ensuring their account information is accurate and that orders placed through their account are authorized. TradeMaster is not liable for unauthorized use of contractor account credentials.
11. Disclaimer of Warranties
THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TRADEMASTER DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRADEMASTER'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. IN NO EVENT SHALL TRADEMASTER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless TradeMaster LLC, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) inaccurate information you provided; or (d) damage to property resulting from delivery to a site you designated.
13. Dispute Resolution
Any dispute arising from or related to these Terms or your use of the Platform shall be resolved by binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.
15. Changes to These Terms
We may update these Terms at any time. Material changes will be reflected by an updated Effective Date. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
